The owners want the NCDOT to pay them damages for nearly 2 decades of time that the DOT has tied up their land, making it nearly impossible to sell or develop.
Their attorney, Matthew Bryant, who won an important, landmark decision in the NC Court of Appeals (a 3 Judge Panel) recently on the DOT’s use of the Map Act, says “the state’s improper exercise of its power to control its future acquisition cost is unequal treatment by defendants NC Department of Transportation and constitutes a wrongful taking of the property.” This is an inverse condemnation claim (see website www.takingland.com for more information).
The lawsuit involves properties near Lees Chapel Road, Hillcroft, Old mine and Yanceyville roads.
Use of the Map Act by the NCDOT restricts what owners can do with their properties with an indefinite time period. “The Map Act has the intended effect of freezing development in the proposed corridor.”
